These General Conditions are intended to regulate the terms and conditions under which the provision of the Service on the RentalBike.pt website, owned by Bike Zone, SA, with VAT number 506913643, which is also the registration number of the Aveiro Commercial Registry, with the activity open for this purpose, and a share capital of 200,000 euros, hereinafter referred to as “Bike Zone.”
The Service consists of providing access to the RentalBike.pt website, which, in addition to providing information about a set of products and/or services, allows the User, electronically, to make reservations for the products disclosed therein, under the terms and conditions described here.
The reservation of products and services must be made by Users aged 18 (eighteen) years or older (individuals under this age must have the authorization of their legal representatives). The elements and information transmitted by the User shall have full legal effect, with the User recognizing electronic acquisitions, and cannot claim the lack of a signature for the non-fulfillment of assumed obligations.
Bike Zone will make every effort to ensure that the information presented on the RentalBike.pt website does not contain typographical errors, and any such errors will be promptly corrected whenever they occur. If the User reserves a product or service that has different characteristics from those presented online, the right to terminate the purchase contract under the applicable legal terms is granted.
Bike Zone will make every effort to provide all ordered services, but it is possible that, in certain cases and due to causes that are difficult to control by Bike Zone, such as human errors or incidents in computer systems, it may not be possible to provide some of the services requested by the User. If any service is not available after an order has been placed, the User will be notified by email or by phone. At that time, a solution or the possibility of canceling the order with a corresponding refund, if payment has already been made, will be presented.
All information regarding price, products, specifications, promotional actions, and services may be changed at any time by Bike Zone without prior notice.
All services marketed on the RentalBike.pt website comply with Portuguese law, and any dispute shall be resolved in Portuguese courts.
Bike Zone is not responsible for damages or losses arising from the non-compliance or defective performance of the Service when this cannot be directly or indirectly attributed to it as willful misconduct or gross negligence, particularly not being responsible for:
(i) errors, omissions, or other inaccuracies in the information provided through the Service;
(ii) damages caused by the User’s fault or by third parties;
(iii) non-compliance or defective performance resulting from compliance with judicial decisions or administrative authorities;
(iv) non-compliance or defective performance resulting from the occurrence of force majeure, i.e., extraordinary or unforeseeable situations beyond the control of Bike Zone, such as fires, power cuts, explosions, wars, riots, civil disturbances, government decisions, strikes, earthquakes, floods, or other natural catastrophes or situations beyond the control of Bike Zone that prevent or hinder the fulfillment of obligations.
Bike Zone does not guarantee that:
(i) the Service will be provided uninterrupted, secure, error-free, or infinite; (ii) the quality of any product, service, information, or other material obtained through the Service will meet any User expectations regarding it; (iii) any material or service obtained in any way through the use of the Service is used at the User’s own risk, and the User is solely responsible for any damage caused; (iv) any advice or information, whether oral or written, obtained by the User from or through the Service, will create any warranty not expressly stated in these General Conditions.
The User accepts that Bike Zone cannot in any way be held responsible for any damage, including but not limited to, damages for loss of profits, data, content, or any other losses (even if the User has been previously advised by the User about the possibility of such damages) resulting from:
(i) the use or inability to use the Service;
(ii) the cost of acquiring substitute goods and services or performance of services;
(iii) unauthorized access or alterations to its transmissions or data;
(iv) statements or conduct of third parties in the Service;
(v) any other matter related to the Service;
Bike Zone is not responsible for the opinions expressed by Users on the RentalBike.pt website, reserving the right to delete or not publish any opinions that may be considered offensive or violate applicable law.
